1. We refer to the above and in particular to your evenly numbered letter dated 21 December 2012.
2. We are instructed to record our clients’ dismay at the fact that, some eight months after the appeal has been noted, the record in this matter has still not been compiled.
3. To make matters worse the record compiled, in accordance with the index attached to your correspondence under reply, regrettably, indicates an absolute misconception with regard to the nature of the appeal.  This is not an appeal against the refusal of bail and item number 1, together with the annexures thereto, are wholly irrelevant to the appeal.
