Excerpts from the “Notice of Appeal”
WHEREAS the Honourable Mr Justice Kruger forfeited the bail money of accused number 1 (hereinafter referred to as the Appellant) in the amount of R 1 million on 13 March 2012 in the above Honourable Court;
AND WHEREAS the Honourable Mr Justice Kruger then cancelled the bail of the Appellant and remanded him into custody;

On 21 October 2011 this matter was adjourned to 5 March 2012 for trial. Accused 1 was not represented on that day.
I quote from the record of proceedings of 21 October 2011, which order Mr Krause, who appears on behalf of accused 1, has confirmed to be correct. No doubt this confirmation is on the instructions of accused 1 as Mr Krause was not in court on 21 October 2011. The relevant extract reads as follows –
“This matter will proceed on 5 March 2012 and will be set down until 30 March. Mr Mabaso, I suggest that you contact your legal representatives and tell them to move with that application to have some of your assets released because we don’t want a situation where four or five days before the time they only find out that the matter can’t proceed or you need somebody from Legal Aid.
